Abstract
Summary:
Reasoning based on the Islamic legal objectives (maqasid al-shari'ah) involves examining the realization of the interests and purposes for which the rulings were legislated, regardless of their rank, and basing the ruling on the outcome of this examination. The ruling that achieves these objectives or the strongest and most dominant of them when they conflict is then given. Accordingly, this dissertation aims to investigate the issue of the Islamic legal objectives (maqasid al-shari'ah) at their various levels - general, specific, and partial - as evidence for the rulings on financial transactions.
The research has concluded that reasoning based on objectives (istidlalbil-maqasid) is of two types: direct reasoning, which is subject to a set of controls and criteria that protect it from deviating from the principles of the Shari'ah in determining rulings on one hand, and realizing the legal interests on the other; and indirect reasoning, which is done through reasoning based on some Islamic fundamentalist (usuli) interest-based approaches, such as unrestricted public interests (masalihmursalah), juristic discretion (istihsan), and the prohibition of means (sadd al-dhara'i').
