السيادة الشعبية في النظام الدستوري الجزائري

Abstract

ملخص: نجد أنه من واجبنا أن نشير إلى أن السيادة في الدولة لا تخضع فقط لإرادة الشعب أو الحكام بل إنها تخضع للمجتمع الدولي الذي أصبح يتحكم مؤخرا في النظام السياسي الداخلي والخارجي للدولة وبالتالي في السيادة الداخلية والخارجية للدولة، وإذا كانت هذه الظاهرة تنافي ما تمت دراسته حتى الآن عن مميزات السيادة، فإن هذا التطور قد فرض بسبب الإتجاه الدولي نحو العولمة، وتتجلى هذه الظاهرة بوضوح من خلال الضغوط التي تتعرض لها المجتمعات الإسلامية بهدف تغيير نظامها الإسلامي. Résumé Nous estimons qu'il est de notre devoir de souligner que la souveraineté de l'Etat est soumisé non seulement à la volonté du peuple ou les dirigeants, mais elle est soumisé à la communauté internationale, qui est devenu le contrôle du système politique interne et externe de l'Etat et donc de la souveraineté interne et externe de l'Etat, si ce phénomène est contraire à ce qui a été étudié jusqu'à présent des caractèque de la souveraineté, cette évolution a été imposée en raison de la tendance internationale à la mondialisation, et ce phénomène est clairement manifesté par les pressions exercées sur les communautés musulmanes dans le but de changer leurs système islamique. Summary We find it our duty to point out that the sovereignty of the state not only to the will of the people or rulers, but they are subject to the international community, which has recently become in control of internal and external political system of the state and therefore in the internal and external sovereignty of the state, and whether this phenomenon is contrary to what has been studied so far are subject all features of sovereignty, this evolution has been imposed due to the international trend towards globalization, and this phenomenon is manifested clearly through the pressures on the Muslim communities in order to change the Islamic system.
