التخريج الفقهي في المعيار المعرب للونشريسي

Abstract

ومن أعظم الكتب التي جمعت المسائل المستخرجة كتاب الميار "المأرب وجامع المغرب في فتاوى أهل إفريقية والأندلس و" "المغرب" لأبي العباس أحمد بن يحيى الونشريسي (ت ٩١٤هـ). هكذا لماذا وكان هذا الكتاب موضوع بحثي. وقد تناول هذا البحث جانبين، نظري وتطبيقي، تناول الجانب النظري تنظير التخريج و أصوله و قواعده، مع تخريجه بفرعيه على الأصول والفروع، والعملي عني مع ذكر أمثلة من المعايير المعبر عنها ودراستها. وقد اعتبر علماء المالكية التخريج طريقا الاجتهاد الذي استخدموه فيه لإثراء مذهبهم، والأمثلة الدالة على ذلك والفتاوى لا تعد كثيرة. One of the greatest books that collected the extracted issues, is the book “Al-Miyar Al-Ma’rib wa Al-Jami’ Al-Maghrib on the Fatwas of the People of Ifriqiya, Andalusia and Al-Maghrib” by Abu Al-Abbas Ahmed Bin Yahya Al-Wonsharisi (914 AH). Thus why This book was the subject of my research. This research had two aspects, theoretical and applied, the theoretical about the theorizing of Takhrij and its origins and rules, with its two branches of graduation on the origins and the branches, and the practical about me mentioning examples from the expressed criterion and studying them. Malikit scholars considered al-takhrij a path of ijtihad, in which they used it to enrich their madhhab, and the evidencing examples of their fatwas are not counted as numerous.
