Abstract

تهدف هذه الأطروحة في شقها الدراسي للتعريف بسيرة الإمام ابن ناجي القيرواني، والكشف عن تفاصيل حياته الشخصية والعلمية والعملية، وأيضا بيان وتوضيح منهجه في كتابه شرح التفريع، سواء في الجانب الفقهي أو القضائي، أو في طريقته العامة في التأليف، مع الإجابة عن بعض الأسئلة، وأهمُّها: هل كان ابن ناجي شخصية فقهية ناقلة أم ناقدة؟، هل خالف في فتاويه وأحكامه القضائية المشهورَ في عصره؟ ولماذا؟، ما محل كتابه شرح التفريع من كتبه الأخرى، من حيث الترتيب الزمني، والقيمة المضافة. أما الشق الثاني من الأطروحة فيهدف لتحقيق جزء من شرح التفريع [من بداية الكتاب إلى آخر الصلاة] تحقيقا علميا، وإخراجه في صورة تقاربُ النصَّ الأصلي الذي كتبه المؤلف. Abstract Summary of the research The thesis aims to introduce the biography of Imam Ibn Naji Al-Kairouani, revealing details of his personal, academic, and practical life, as well as elucidating his methodology in his commentary on “At- Tafri'a”, whether in the jurisprudential or judicial aspects, or in his general approach to writing, while also addressing some questions, including: Was Ibn Najee a transmitting or critical juristic figure? Did he contradict the famous opinions and judicial rulings of his time, and why? Where does his book “Sharh At- Tafri'a” stand among his other works in terms of chronological order and added value? The second part of the thesis aims to scientifically manuscript verification a portion of “Sharh At-Tafreej” (from the beginning of the book to the end of the prayer), presenting it in a format that closely resembles the original text written by the author.
