التخريج الفقهي عند ابن رشد الجد

Abstract

تتمحور فكرة البحث في محاولة إبراز جانب علمي مهم، في تراث شخصية علمية أندلسية من فطاحل وعلماء المذهب المالكي، ويتعلق الأمر بالتخريج الفقهي عند القاضي أبي الوليد ابن رشد الجد، حيث درست الموضوع من جانبين: النظري وعني بالتنظير للتخريج الفقهي عند ابن رشد بذكر مفهومه ومصادره وطرقه وأحكامه، وشروطه، ومنزلة ابن رشد الاجتهادية، والتطبيقي عني بدراسة مسائل مختارة من كتب الإمام اعتمد فيها التخريج الفقهي، والتي ساهم بها في إثراء المذهب المالكي . Abstract The idea of the research is centered on trying to highlight an important scientific aspect, in the legacy of Andalusian scholarly figyre from the greatest scholars of the malikiscool doctrine, and the subject is related of the Jurisprudential graduation according to judge aduAl_Walid Ibn Rushd al jad, where I studied the subject from two aspect: the theoretical, which mean theorizing for the Jurisprudential graduation. According to Ibn Rushd it nentions its concept, sources, methods, rulings, and condition, and Ibn Rushd's status of Jurisprudence, and the applied approach which means studying selected issues from the Imam's dooks in which Jurisprudential interpretation was adopted, and through which he contributed enriching the Maliki doctrine.
