Abstract

الملخص: لقد تناولت هذه الدراسة موضوع دراسة المسائل التي خالف فيها ابن القاسم شيخه الإمام مالكا، وقد احتوى خمسة فصول وهي، أما الفصل الأول فيه الأقوال التي خالف فيها ابن القاسم مالكا في الطهارة والصلاة والزكاة والصوم والاعتكاف، ثم كان الفصل الثاني وفيه الأقوال التي خالف فيها ابن قاسم مالكا في الإيمان والنذور والصيد والأضحية، والحج والجهاد والنكاح، أما الفصل الثالث ذكرت فيه الأقوال التي خالف فيها ابن القاسم مالكا المعاملات والبيوع وخصصنا فصل الرابع وتحدثت فيه عن الأقوال التي خالف فيها ابن القاسم مالكا في مسائل مختلفة في البيوع والمديان، ثم كان فصل الخامس وفيه مسائل القصاص والحدود وأحكام العتق، لقد تبين من خلال هذه الدراسة مكانة ابن القاسم العلمية وجهوده في نشر مذهب الإمام مالك، بلغت شهرته أقصى المشرق والمغرب وقدم خدمات قيمة في الفقه المالكي، ابن القاسم من العلماء المجتهدين المنتسبين في اجتهادهم إلى المذهب الإمام مالك. أما الخاتمة فقد احتوت جملة من النتائج والتوصيات. الكلمات المفتاحية: الإمام مالك، ابن القاسم، الفقه المالكي. Summary: This study dealt with the subject of studying the issues in which Ibn Qasim disagreed with his sheikh, Imam Malik, and it contained five chapters, which are: The first chapter contains the sayings in which Ibn al-Qasim disagreed with Malik regarding purity, prayer, zakat, fasting, and seclusion, then the second chapter contains the sayings in which Ibn al-Qasim disagreed with Malik. Qasim Malik on faith, vows, hunting, sacrifice, Hajj, efforts, and marriage. As for the third chapter, I mentioned the sayings in which Ibn al-Qasim Malik disagreed with equations and sales, and we devoted the fourth chapter in which I talked about the sayings in which Ibn al-Qasim disagreed with Malik on various issues regarding sales and money.
