ضوابط إعمال المقاصد في الإجتهاد المعاصر

Abstract

تهدف هذه الدراسة إلى العناية بالاجتهاد المقاصدي المعاصر وذلك ببيان الدور المنشود لإعمال المقاصد وفق ضوابط محددة، وكيفية استثمارها في تقديم الحلول الشرعية للقضايا المعاصرة وكذا تقديم رؤية نقدية لمن غالوا في اعتبار المقاصد من غير ضابط ولا قيد. وبناء على هذا جاءت الإشكالية الرئيسية التالية: ما هي أهم الضوابط والقيود الواجب استحضارها في عملية مراعاة المقاصد في العملية الاجتهادية؟ وهل يصح اعتبار المقاصد دليلا مستقلا لاستنباط الأحكام الشرعية؟ This study aims to focus on contemporary purposive jurisprudential reasoning by elucidating the intended role of implementing purposes within specific guidelines. It explores how to effectively utilize these purposes to provide Islamic Law compliant solutions to modern issues. Additionally, the study presents a critical analysis of those who have exaggerated the consideration of purposes without proper criteria or limitations. Consequently, the following main problem arises: What are the most important guidelines and restrictions that must be taken into account in the process of considering purposes within the jurisprudential reasoning framework? Furthermore, it examines the validity of considering purposes as independent evidence for deducing Islamic Law verdicts.
