التنازل عن الحق للغير بعوض في مسائل الأحوال الشخصية

Abstract

تدور فكرة هذه الأطروحة حول ماهية التنازل عن الحق للغير بعوض مالي ، ودليل مشروعيته وطبيعته الفقهية وأقسامه ، كما أبرز الباحث في المصطلحات الفقهية القريبة من مصطلح التنازل وبين علاقته بها ، وهو ما حاول توضيحه في هذه النقاط ، وقد جاءت الأطروحة في مقدمة ، خمسة فصول وخاتمة كانت الفصول في بيان مفهوم التنازل عن الحق بعوض وعلاقته ببعض المصطلحات الفقهية الأخرى وفي مشروعية التنازل عن الحق بعوض أقسامه وفي بيان الحقوق وقابليتها للتنازل والعوض ، وفي نماذج تطبيقية في مسائل الأحوال الشخصية ، أما الخاتمة فقد ضمنها أهم النتائج والتوصيات Abstract The idea of this thesis revolves around explaning what is the assignement of the right to others whith a financial compensation and evidence of its legimitimacy and the nature the jurisprudence and its divisions the research also highlighted some jurisprudential terms close to the term of assignement and explained its relationship to it which he tried to clarify in the points and the this came in a introduction five chapitre in conclusion the relationship to some jurisprudentiel terms and the legality of assigning the right of compensasion the nature of contract of assignement of the rihgt of compensation and its division and in explaning the right and their ability to assign and remuneration and in important findings and recommandations
