القواعد المشتركة بين فني الفقه والأصول

Abstract

يتناول هذا البحث القواعد المشتركة بين تقنيات الفقه وتقنياته المبادئ - دراسة نظرية تطبيقية - تتضمن ثلاثة فصول: الفصل التمهيدي: غرضه التعريف بالقواعد المشتركة، بذكر ما هو مفيد في تسهيل تأصيلها، وما هي وسائل حل ألغازها، مثل تعريف القواعد الفقهية والأصولية وأقسامها وأوجه التشابه والاختلاف بينها موضوع كل منها، وما يتعلق بتعدد الموضوع. أما الفصل الأول: فقد تضمن وضع القواعد المشتركة، وتوضيح آراء السادة عنها أهل العلم، مع بيان تعريفها وأقسامها، وجذور القواعد المشتركة تسهيل تحديد الهوية. أما الفصل الثاني: فقد تناولت تطبيقه باختيار إحدى عشرة قاعدة، ووزعتها حسب التصنيف الأساسي، واختتمت بشرح كيفية تنفيذها في This research deals with the common rules between the techniques of jurisprudence and principles - an applied theoretical study - which includes three chapters: The introductory chapter: Its purpose was to introduce the common rules, by mentioning what is useful in facilitating their rooting, and what are the means of solving their mysteries, such as defining the jurisprudential and fundamental rules, their divisions, similarities and differences between them, the subject of each of them, and what is related to the multiplicity of the subject. As for the first chapter: it included establishing the common rules, clarifying the opinions of the scholars about them, explaining their definition and divisions, and the roots of the common rules to facilitate identification. As for the second chapter: I dealt with its application by choosing eleven rules, distributed them according to the fundamental classification, and concluded by explaining how to implement them in the two sciences by branching out into themعلمين بالتفرع فيهما
