Abstract

الملخص: لضمان حسن سير الإدارة العمومية على المستوى المحلي يقتضي أن يتم تفويض بعض الاختصاصات من السلطة المركزية إلى الهيئات المحلية، و هذا ما يعرف بعدم التركيز الإداري. و على اعتبار أن الوالي ممثل للدولة على المستوى المحلي يستلزم الأمر أن نبحث عن كيفية تنظيم المنظومة القانونية لمركز الوالي، و في هذا الإطار تندرج الإشكالية التالية: هل وفق المشرع الجزائري في تحقيق التوازن بين الاستقلالية القانونية للوالي، و بين خضوعه و تبعيته للسلطة المركزية ؟ و هذا ما حاولنا دراسته في هذا الموضوع. و في الواقع نجد أن الوالي يعاني من تبعية مفرطة للسلطة المركزية. Résumé : Pour assurer le bon fonctionnement de l'administration publique au niveau local sont nécessaires pour déléguer certaines compétences de la centrale aux organismes locaux, ce qui est ce qui est connu comme focus.
