اليات تسيير الاملاك الوطنية العمومية التابعة للدولة

Abstract

الملخص : تحظى دراسة الأملاك الوطنية في مختلف الدول باهتمام الباحثين المختصين في مختلف المجالات، والجزائر كغيرها من البلدان التي تعد ثرواتها وخاصة الأملاك الوطنية بما فيها العمومية والخاصة عماد اقتصادها الوطني، إذ خصصنا هذه الدراسة لآليات تسيير الأملاك العمومية التابعة للدولة من خلال إبراز نظام قانوني الذي وضعه المشروع الجزائري لتسيير هذا النوع من الأملاك إذ اعتمدنا في دراستنا على القانون رقم 90 – 30 المتعلق بالأملاك الوطنية العمومية المعدل والمتمم بموجب القانون 08 – 14، بالإضافة إلى جميع النصوص القانونية و التنظيمية السارية المفعول . حيث تناولنا مفهوم الأملاك الوطنية العمومية وتمييزها عن الأملاك الأخرى، ثم تطرقنا إلى الأجهزة الإدارية المكلفة بتسييرها ومراقبتها وهيكلتها، دون أن ننسى طرق وآليات تسييرها ،كل هذا من أجل تقديم دراسة قانونية واضحة وعملية لكيفية إدارة وتسيير الأملاك الوطنية العمومية التابعة للدولة Le résumer : L’étude des biens publics a bénéfice d’un grand intérêt dans tous les états de la part de nombreux experts dans plusieurs domaines‚ et l’Algérie ne fait pas l’exception .les biens publics et privés en Algérie sont considérais comme la base de l’économie nationale. Nous avons consacré notre recherche à l’étude des mécanismes de gestion des biens publics tributaires de l’état‚ en essayant de lier au loi l’ordre juridique établi par le législateur algérien pour gérer ce genre de biens . On sert basé dans notre étude sur la loi nᵒ 90-30 relative aux biens nationaux amendée et complétée par la loi nᵒ 08-14 ‚ de plus des différents textes juridiques et réglementaires en vigueur. Comme nous avons abordé le sens de bien notionnel public‚ on le distinguant du autre biens‚ ensuite on a pausé en revue les dispositifs administratifs chargés de la gestion et de contrôle et de sa structuration sans oublier les mécanismes de gestion‚ Tout cela pour présenter une étude juridique claire et pratique pour gérer et administrer les biens publics nationaux tributaire de l’état Abstract : Enjoy the study of national properties in different countries interest specialists in various fields, researchers, and Algeria, like other countries, which is the wealth and private national properties, including public and private Imad national economy, as we have dedicated this study of the mechanisms of functioning of the state of public property by highlighting the legal system developed by the project Algerian to conduct this type of property as we have adopted in our study law No. 90-30 on national public Proprietary modified and complemented by law 08-14, as well as all legal and regulatory provisions in force. Where we dealt with the concept of national public property and distinguished from other property, and then we dealt with the charge of Ptsaerha, monitoring and restructuring the administrative organs, without forgetting the ways and mechanisms of conduct, all of this in order to provide a clear legal study and the process of how the administration and management of national public property of the state.
