Abstract

الملخص: يعتبر مبدأ حياد الادارة العامة في الجزائر من أهم المبادئ التي يجب على الادارة الالتزام بها سواء من الناحية الوظيفية أو الانتخابية،فالحياد يتطلب تظافر كل الجهود و كل الطاقات دون استثناء لتكوين دولة مستقرة و ملتزمة بهذا المبدأ. فباعتبار مبدأ حياد الادارة العامة لا يهدد استقرار الدولة فقط،بل الأسرة الدولية ككل،منها رؤساء ومرؤوسين ،حيث من الواجب عدم التحيز إلى طرف على حساب آخر،وهذا ما قام به المشرع الجزائري و ذلك من خلال إصداره مجموعة من القوانين و التنظيمات لتنظيم مبدأ الحياد La résumé: Le principe de la neutralité de l'administration publique en Algérie des principes les plus importants qui doivent être sur l'administration neutralité soit fonctionnellement ou électorale, neutralité exige concertés de tous les efforts et toutes les énergies, sans exception, pour former un stable et engagé à ce principe. Considérant principe de neutralité de l'administration publique, non seulement menace la stabilité de l'État, mais la communauté internationale dans son ensemble, y compris les chefs et subordonnés, où le devoir d'impartialité au parti au détriment d'un autre, et cela se fait par le législateur algérien et par l'émission d'une série de lois et obligations pour l'organisation de principe de neutralité.
