الحماية القانونية للبيئة في التشريع الجزائري

Abstract

الملخص: - يتناول موضوع البحث المعنون "بالحماية القانونية للبيئة في التشريع الجزائري"، الوسائل القانونية الوقائية لحماية البيئة باعتبارها هدف رئيسي تسعى السياسة البيئية إلى تحقيقه لتفادي وقوع كوارث بيئية ،كما تتناول الدراسة الجزاءات المترتبة على مخالفة الإجراءات الوقائية لحماية البيئة . - يتعرض الفصل الأول من البحث إلى النظام البيئي و وسائل حمايته بمناقشة فعالية الآليات القانونية الوقائية لحماية البيئة، و المتمثلة في الدور الوقائي للإدارة البيئية بشقيها المركزي و المحلي، و بمشاركة الجمعيات في ذلك. - كما تناول الفصل الثاني العقوبات و الجزاءات الإدارية المختلفة للحدّ من الجرائم البيئية ،كما أرسى القانون الجنائي نظاما ردعيّا صارما للاعتداءات الّتي تقام ضدّ البيئة و ذلك من خلال تصنيف الجرائم الخاصة بحماية البيئة و معاينتها، إضافة إلى الجزاء المدني من خلال تطوير الجوانب الإجرائية و الموضوعية للمسؤولية المدنية لاحتضان الضرر البيئي ، من خلال إعادة النظر في نظام التعويض، و الانتقال من المسؤولية المدنية الإصلاحية إلى المسؤولية المدنية المحتملة المبنية على أساس الاحتياط. الكلمات المفتاحية: البيئة- التنمية المستدامة – حماية البيئة .

RESUME : Offres avec le sujet de la recherche intitulé « la protection juridique de l’environnement dans le droit algérien »les moyens légaux de prévention pour protéger l’environnement constitut un but essentiel à attendre par la politique envirementale pour éviter les catastrophes ,ainsi notre étude aborde également les sanction en cas de violation des mesures préventives pour protéger l’environnement . - Exposez le premier chapitre de la recherche sur l'écosystème et les moyens de protéger discuter de l'efficacité des mécanismes juridiques préventives pour protéger l'environnement, et du rôle préventif de la gestion de l'environnement dans les deux niveaux central et local, et avec la participation des associations en elle. - Le deuxième chapitre des sanctions et diverses sanctions administratives pour freiner les crimes environnementaux, comme prévu système de droit pénal attaques sévères montées contre l'environnement et que, en classant la protection de l'environnement et prévisualisées crimes, en plus de la sanction civile lors de l'élaboration des aspects de procédure et de l'objectivité responsabilité civile pour embrasser les dommages environnementaux, à travers la révision du système de compensation, et la transition de la réforme de la responsabilité civile à la responsabilité civile potentielle basée sur la base de la réserve
