Abstract

-مـلخـص: إن أجل رفع الدعوى الإدارية يبدأ من تاريخ تبليغ القرار أو نشره بالنسبة للمنازعات العامة والتظلم الإداري فيها يكون اختياريا، أما بالنسبة للمنازعات الخاصة فنظمتها بعض النصوص القانونية الخاصة منها من اشترطت التظلم الإداري ومنها من جعلته اختياريا، إلا أنه هناك حالات مستثناة من شرط الآجال سواء بحكم طبيعة الدعوى أو النزاع أو قضائيا، وتعتبر آجال رفع الدعوى الإدارية قابلة للامتداد والانقطاع ونشير إلا أن شرط الآجال متعلق بالنظام العام ومن تم يتعين أن يثيره القاضي من تلقاء نفسه، وللخصم أن يدفع بعد احترامه في أية مرحلة كانت عليها الدعوى. -Résumé : Le délai d'élever la procédure administrative commence de la date de notification de décision administrative ou de la date de publication pour les litiges publics, ou le recours administratif soit optionnel.
