التوفيق الدولي كوسيلة سلمية لحل النزاعات

Abstract

يعد التوفيق الدولي من ضمن الحلول السياسية السلمية لتسوية النزاعات الدولية وهواتفاق الأطراف المتنازعة على تسوية النزاع يمما بينها عن طريق أعضاء يقومون باختيارهم، حيث تعمل لجان التوفيق على قريب وجهات النظر بين طرفي النزاع و تقديم الاقتراحات المناسبة دون ترتيب أي آثارإلزاميةعلىأطرافه.كماتعتبرفيكنيرمن الأحيان همزةوصل ومقدمةلصدوراحكامالتحكيم الملزمة. وانطلاقا من هذا المضمون ، ونظرا للخصائص التى يتمتع بها أسلوب التوفيق الدولي ،فقد نجح في وضع حد للعديد من النزاعات الدولية ، خصوصا بعد الحرب العالمية الثانية وظهور هيئة الأمم المتحدة حيث احتوت الكثير من الاتفاقيات الدولية الشارعة على نصوص تشير إلى ضرورة حل النزاعات بين الدول بواسطة لجان التوفيق الدولية . La réconciliation est parmi les solutions politiques amicales, pour régler les conflits international, c’est que les deux cotés se mettent d’accord à travers des membres qu’ils ont choisis. Le travail de la commission de réconciliation consiste à converger les points de vues et à présenter des solutions appropriées sans aucune obligation comme elle est un lien et une introduction d’émission de dispositions contraignantes d’arbitrage. Et à travers ce contexte et selon les caractéristiques de la réconciliation mondiale, il a réussi à mettre point à beaucoup de conflits internationaux et spécialement après la deuxième guerre mondiale et l’apparition de l’O.N.V qui figurant beaucoup d’accords normatifs sur les textes qui mènent à une désexcités de résolution de conflits internationales à travers des comités de conciliation international.

Reconciliation is considered one of the peaceful political solutions to settle international conflicts. It is an agreement between them through members whan they chose them. So, the reconciliation conmittees worh on the appoach of the disputed parts points of view and give the suitable suggestions without resulting any obligations on them. It is always considered as an introduction to the emission of the obligatory – arbitration jugements. Starting from this content and according to the international reconciliation characteristic, it succeeded in putting an end to different international conflits especially after the WW2 and the appearance of the United Nations Organization which involved various international treaties depending on articles that refer to the necessity of solving the conflits between countries through the international reconciliation committees.
