Abstract

ملخص: رغم أن الاتفاقية العامة للتعريفة الجمركية و التجارة كان الهدف منها التحضير لتأسيس منظمة عالمية، إلا أنها دامت عدة عقود من الزمن، حيث عرفت عدة جولات اختتمت بجولة الأوروغواي التي تم بموجبها إنشاء المنظمة العالمية للتجارة، هذه الأخيرة و منذ حوالي عشرين سنة من النشاط استطاعت أن تضم أكثر من 160 عضو عبر العالم لتحوز على معظم التبادلات التجارية العالمية و لعل أكثر الدول الأعضاء فيها هي نامية تبحث عن إنعاش اقتصادياتها و تطوير صناعاتها المحلية مقابل فتح أسواقها للدول العظمى. و في هذا السياق نلاحظ أن الجزائر أيضا أبدت رغبتها في الانضمام للمنظمة منذ عدة سنوات، حيث قامت بعدة جولات تفاوض ثنائية و أخرى متعدّدة الأطراف مع عدّة دول تهتم بالسوق الجزائرية. و لأجل تحقيق هدف الانضمام باشرت بعدة إصلاحات مسّت منظومتها القانونية بُغية مسايرة متطلبات المنظمة العالمية للتجارة، واستجابة لما تُمليه الدول التي تتفاوض معها، غير أنها و لغاية اليوم لم تنضم رسميا إلى المنظمة لعدة أسباب لعل من أهمها معارضة بعض الدول التي لا ترى في مناخ الأعمال الجزائري مستجيبا للحد الأدنى لمتطلبات العضوية. Résumé: Bien que la convention générale des tarifs douaniers et du commerce était destiné à préparer à la création d'une organisation mondiale, néanmoins elle a duré plusieurs décennies, Où elle a reconnait plusieurs tournées, la dernière est celle de l'Uruguay, en vertu de laquelle il a été procédé à la création de l'Organisation mondiale du commerce, cette dernière, et depuis une vingtaine d'années d'activité, a été en mesure d'inclure plus de 160 membres à travers le monde pour acquérir la totalité des échanges commerciaux et peut-être la plupart des États membres sont ceux en développement qui cherchent de relancer leur économie et développer leurs industries nationales afin d’ouvrir leurs marchés aux grandes nations. Dans ce contexte, nous notons que l'Algérie a également exprimé son désir d'adhérer à l'organisation depuis plusieurs années ; elle a effectué plusieurs tournées de négociation bilatérales et autres négociations multilatérales avec différentes pays qui s’intéressent par le marché Algérien. Afin d'atteindre l'objectif de l'adhésion, elle a lancé un certain nombre de réformes juridiques afin de suivre les exigences de l'Organisation mondiale du commerce, et répondre aux préceptes des pays qui négocient avec eux, en revanche et jusqu’à ce jour, elle n'a pas été officiellement adhérer à l'organisation pour plusieurs raisons, notamment l'opposition de certains pays qui ne voient pas dans le climat des activités Algériennes une réponse minimales aux exigences de l’adhésion.
