تحقيق المصطلحات الشرعية و أثره في ضبط الفتاوى المعاصرة - دراسة نظرية تطبيقية

Abstract

الملخص: المصطلحات الشرعية هي الأوعية الحرفية للمعاني المقصودة للشارع الحكيم، لذا تتوقف معرفة حقائق الشرائع على إدراك الحمولة المعنوية لهذه المصطلحات على وجهها الصحيح، ومساهمة في تيسير سبل ذلك، جاء هذا البحث مشاركة أكاديمية في تحقيق المعاني الشرعية لثلاث مصطلحات هي الأكثر تداولا في الخطاب الدعوي: ( الطاعة، البدعة، والمصلحة )، وقد قدَّمته بمدخل تمهيدي، عرَّفت فيه المصطلح محاولا إيضاح عن العلاقة المفاهيمية بينه وبين أبرز بدائله اللفظية كالمفهوم والحد والتعريف، ثم بيَّنت المقصد بتحقيق المصطلح، حيث خلصت إلى أنَّه: تحديد قيمته الدلالية المركزية وبيان قيمه الإضافية والحافة، ثم محاكمة الجميع إلى النسق الدلالي الشرعي للكشف عن محددات المفهوم داخل هذا النسق. أما المصطلحات المختارة، فقد تتبعتها معجميا قاصدا إلى تحديد الدلالة المركزية لكلِّ منها وتمييز دلالاته الإضافية، ثم الكشف عن النقل المفهومي في السياق الشرعي لكلِّ مصطلح، ومن ثمَّ إبراز معالم المصطلح محل البحث في الشريعة، ومنها إلى بيان الحقيقة الشرعية له وأبرز علائقه أو ضمائمه، وختمت كلَّ فصل بمبحث تطبيقي اخترت فيه نماذج لفتاوى تتأسس أحكامها على المصطلحات المختارة حيث يؤدي الخلل في تحقيقها إلى الزلل في الفتوى Summary: Examination of legal terminology and its impact on controlling contemporary fatwas - an applied theoretical study - The legal terms are the literal containers for the intended meanings of the wise street, so knowing the facts of the laws depends on realizing the moral load of these terms in their correct form, and a contribution to facilitating the ways of that. obedience, heresy, and interest), and I presented it with an introductory introduction, in which I defined the term, trying to clarify the conceptual relationship between it and its most prominent verbal alternatives, such as the concept, the limit, and the definition, then I explained the purpose of realizing the term, as I concluded that: defining its central semantic value and indicating its additional values and the edge, then The trial of everyone to the legal semantic format to reveal the determinants of the concept within this format. As for the selected terms, I followed them lexically with the intention of defining the central significance of each of them and distinguishing its additional connotations, then revealing the conceptual transfer in the legal context of each term, and then highlighting the features of the term in question in the Sharia, and from them to clarifying the legal truth of it and its most prominent relationships or inclusions, I concluded each chapter with an applied topic, in which I chose models for fatwas whose rulings are based on the chosen terminology, as failure to achieve them leads to error in the fatwa.
