Abstract

الملخص: تتسم البيئة الدولية الراهنة باحتدام التنافس على رؤوس الأموال الأجنبية بين مختلف الدول المتقدمة و الدول النامية على حد سواء . وذلك نتيجة للدور الهام الذي يلعبه الاستثمار الأجنبي في توفير التمويل المطلوب لإقامة المشاريع الإنتاجية و نقل التكنولوجيا و المساهمة في رفع مستويات المداخيل والمعيشة و خلق المزيد من فرص العمل التعزيز في قواعد الإنتاج وتحسين المهارات و الخبرات الإدارية و تحقيق ميزات تنافسية في مجال التصدير والتسويق .ويحثل الإستثمار الأجنبي المباشر أهمية استثنائية في الدول النامية التي تعاني من تفاقم أزماتها المالية الشيء الذي زاد من حدته تقلص مصادر التمويل المختلفة و في ظل تصاعد مؤشرات المديونية و تضخم التكاليف المرافقة لاقتراضها من العالم الخارجي فإن مصادر التمويل التي تبقى متاحة أمامها تنحصر في العمل على جلب الإستثمار الأجنبي المباشر من جهة و تنشيط الإستثمار المحلي و السيطرة عليه من جهة أخرى. من هذا المنطق أشتد التنافس بين الدول على جذب الاستثمارات الأجنبية من خلال إزالة الحواجز و العراقيل التي تعيق طريقها و منحها الحوافز و الضمانات التي تسهل قدومها ودخولها إلى السوق المحلي .وفي هذا الإطار قامت كل الدول النامية بوجه عام بسن تشريعات تمنح حوافز مغرية للمستثمرين الأجانب و تزيل كل القيود و الحوافز التي تقف في طريقهم .وكانت الجزائر من بين هذه الدول التي وضعت قوانين استثمار والتي من خلالها تقدم ضمانات واسعة للمستثمرين الأجانب أو المحليين على سواء Abstract: Characterized by the current international environmentBahtdamcompetition for foreign capital between the variousdeveloped countries and developing countries alike.
