Ghafour, Abdelbaki2017-05-022017-05-022015https://dspace.univ-tlemcen.dz/handle/112/10140الجريمة ظاهرة اجتماعية لا يمكن تصورها الا داخل مجتمع، فهي احتمالية في حياة الفرد، حتمية في حياة المجتمع، و ارتباطها بالمجتمع ارتباط طبيعي. فالمجتمع هو الباعث عليها والضحية لها في آن واحد. فهي عمل يصدر من شخص ضد نظام المجتمع الذي يعيش فيــــه. و يعنى ذلك أنها تعبير عن فشل المجرم في التكيف مع مجتمعه، و تعبير كذلك عن فشل المجتمع في تهيئته و اعطائه القدرة للاندماج فيه. فطبيعة المرحلة التي تمر بها حاليا كافة المجتمعات حساسة جدا، وتتطلب الادراك الواعي لأبعادهــــا على ضــــــوء التحــــــولات السريعــــــة و الجذرية للبنى الاقتصادية و السياسية ، التي أفرزت تغيرات اجتماعية و ثقافية هامة لم يكن مخططا لها. مما أدى لظهور العديد من المشكلات الاجتماعية و على رأسها الجريمة، و مما يدعو للقلق أن الجريمة تسجل كل يوم تطورا جديـــــدا فــــــي مظاهرهـــــــــــا و أنماطهـــــــــا ، و استحداثا في أساليبها، و مضاعفات في الخسائر الناجمة عنها، مما يستدعي مواجهتها و التصدي لها. Abstract Crime is a social phenomenon that can only be imagined within a society, it is a possibility in the life of an individual, an inevitability in the life of society, and its connection with society is a natural one. Society is both the cause and the victim of it. It is an act of a person against the order of the society in which he lives. This means that it is an expression of the failure of the criminal to adapt to his society, as well as an expression of the failure of society to prepare him and give him the ability to integrate into it.
